These Website & Portal Terms of Use (“Terms”) govern access to and use of Material’s websites, portals, digital tools, forms, content, communications, and related services (the “Services”). The Services are operated by Arte Que Rico S.A. de C.V. (“Material,” “we,” “us,” or “our”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
- Scope of Services
The Services may include public websites, exhibitor portals, Invited portals, account systems, applications, RSVP tools, ticketing links, digital passes, QR codes, program pages, newsletters, forms, surveys, payment flows, and related digital services for Feria Material, Estación Material, Invited, Itinerary, Listening Material, Proyectos, and related programs.
Additional terms may apply to specific applications, ticket purchases, event attendance, exhibitor participation, sponsorships, partnerships, or other agreements.
- Eligibility and authority
You may use the Services only if you have the legal capacity and authority to do so. If you use the Services on behalf of an organization, gallery, company, institution, or other entity, you represent that you are authorized to bind or act on behalf of that entity.
- Accounts and access
Some Services require an account, invitation, magic link, password, QR code, or other access credential. You are responsible for maintaining the confidentiality and security of your access credentials and for all activity under your account.
You agree to:
- Provide accurate and current information;
- Keep your account information up to date;
- Notify Material promptly of unauthorized access or suspected misuse;
- Not share access credentials with unauthorized persons;
- Not attempt to access areas or data for which you do not have permission.
Material may suspend or terminate access if we believe an account has been misused, compromised, or used in violation of these Terms.
- User roles and collaborators
Where the Services allow multiple users to collaborate on an application, profile, or account, each user is responsible for their own actions. Organization administrators or authorized users are responsible for ensuring that collaborators have appropriate authority and permissions.
- Acceptable use
You agree not to:
- Use the Services for unlawful, misleading, fraudulent, abusive, or harmful purposes;
- Interfere with or disrupt the Services;
- Attempt to reverse engineer, bypass security, scrape, overload, or compromise the Services;
- Upload malware, harmful code, or unauthorized tracking tools;
- Submit content that infringes third-party rights, violates privacy, or is defamatory, discriminatory, hateful, obscene, or otherwise unlawful;
- Impersonate another person or entity;
- Misrepresent your authority, identity, affiliation, or application information.
- Content submitted by users
You are responsible for any information, text, images, files, links, artwork details, proposals, comments, or other materials you submit through the Services (“User Content”).
You represent and warrant that:
- You have the necessary rights, permissions, and authority to submit the User Content;
- Your User Content is accurate to the best of your knowledge;
- Your User Content does not infringe intellectual property, privacy, publicity, confidentiality, or other rights of any third party;
- Your User Content does not violate applicable law or these Terms.
- License to use submitted content
You grant Material a non-exclusive, worldwide, royalty-free license to use, reproduce, store, display, review, translate, format, crop, resize, adapt, and process User Content as necessary to operate the Services, review applications, administer programs, communicate with you, provide technical support, maintain archives, and comply with legal obligations.
Where User Content is submitted in connection with an accepted exhibitor, event, publication, press, website, newsletter, social media, archival, or promotional process, additional rights may be set out in applicable program terms or participation agreements.
- Material content and intellectual property
All content, design, text, graphics, logos, trademarks, images, videos, software, databases, interface elements, and other materials provided by Material are owned by or licensed to Material and are protected by applicable intellectual property laws.
You may not copy, modify, distribute, sell, publish, scrape, reproduce, or create derivative works from Material content except as expressly permitted by Material in writing or as allowed by law.
- Payments and third-party processors
Certain Services may require payment, including application fees, tickets, participation fees, add-ons, extras, or other charges. Payments may be processed by third-party providers such as Stripe, Boletia, or other payment/ticketing partners.
Material does not intentionally collect or store full payment card numbers or CVV codes. Payment errors, declined payments, duplicate payments, chargebacks, and related issues may be reviewed by Material and/or the applicable payment processor.
Additional payment terms may apply to specific transactions.
- Third-party services and links
The Services may link to or integrate with third-party platforms, including payment processors, ticketing platforms, email tools, analytics providers, maps, social media, embedded media, or other services. Material is not responsible for third-party websites, services, terms, privacy practices, or content.
- Service availability and changes
Material may update, suspend, modify, restrict, or discontinue any part of the Services at any time, including for maintenance, security, operational needs, legal compliance, or technical reasons.
Material does not guarantee that the Services will be uninterrupted, error-free, secure, or available at all times.
- No professional advice
Information provided through the Services is for general operational, cultural, commercial, or informational purposes and does not constitute legal, tax, financial, shipping, customs, insurance, or professional advice.
- Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” Material disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free performance, or that the Services will meet your specific requirements.
- Limitation of liability
To the maximum extent permitted by law, Material will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost opportunities, loss of data, reputational harm, or business interruption arising from or related to use of the Services.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability arising from willful misconduct or gross negligence where such exclusion is not permitted.
- Indemnity
You agree to indemnify and hold harmless Material, its officers, directors, employees, collaborators, partners, agents, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your breach of these Terms, misuse of the Services, submitted content, infringement of third-party rights, or violation of law.
- Suspension and termination
Material may suspend or terminate your access to the Services if you violate these Terms, create legal or security risk, submit false or misleading information, misuse the Services, or if continued access is no longer operationally appropriate.
- Privacy
Material’s processing of personal information is described in the Privacy Policy / Integral Privacy Notice.
- Changes to these Terms
Material may update these Terms from time to time. The “Last updated” date indicates the latest revision. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms, unless additional consent is required.
- Governing law and jurisdiction
These Terms are governed by the laws of Mexico. Any dispute arising from or related to these Terms or the Services will be submitted to the competent courts of Mexico City, Mexico, and the parties waive any other jurisdiction that may correspond by reason of present or future domicile or otherwise, except where applicable consumer or mandatory law provides otherwise.
